Final federal overtime rule released
The final overtime regulations were released on May 18 and contained the following:
- It guarantees time-and-half pay to any salaried employee earning under $47,476/year ($913/week) and who works more than 40 hours in a week.
- It automatically updates the salary threshold every three years, tying it to the 40th percentile of full-time salaried workers in the lowest-income Census region. The first update would be on January 1, 2020, and the DOL projects a salary threshold of $51,000 at that time.
- It makes no changes in the duties tests used to determine whether or not a salaried employee above the threshold is considered exempt from overtime pay.
- For the first time, certain bonuses and incentive payments will count toward up to 10 percent of the new salary level if the payments are made on at least a quarterly basis.
- Businesses must be compliant by December 1, 2016.
The Food & Drug Administration has announced that in August, it will begin regulating e-cigarettes as it does all other tobacco products. Health warnings will have to put on the packages and sales to minors will be banned. The FDA stopped short of banning flavored vapors, though that change may happen down the line. No changes have been made to Pennsylvania’s Clean Indoor Air Act, so it remains up to individual businesses to decide whether or not they want to ban e-cigarettes in their establishments.
